THE SITUATION
AI now decides who gets hired, approved for a loan, screened as a tenant, flagged by police, or approved for benefits, often with documented racial bias and no transparency. Civil-rights law hasn't caught up.
Sen. Ed Markey and Rep. Yvette Clarke, Chair of the Congressional Black Caucus, reintroduced the AI Civil Rights Act on Dec 2, 2025 as H.R. 6356 in the House and S. 3308 in the Senate, to require bias testing, transparency, and accountability for automated decision systems.
