THE SITUATION
On June 16, 2026, the Department of Education announced an agreement shifting administration of special education — grants, compliance, and state IDEA performance reviews (about $15.5B) — to Health and Human Services. The move does not change IDEA’s legal guarantees, but disability advocates warn it dilutes IDEA’s educational focus.
★ WHY IT MATTERS
IDEA guarantees a free appropriate public education to about 7.5 million students with disabilities. Handing oversight to an agency with no education expertise risks longer waits, weaker enforcement, and harder fights for families.
★ WHAT WE'RE DEMANDING
Congress must hold hearings and stop the transfer of IDEA out of the Department of Education.
